There is a status quo order passed by the civil court in connection with T.S. No. 28 of 2022. Report submitted by the State also reflects that there were certain disputes for which proceedings under section 126 of the BNSS has been drawn by the police authorities and submitted before the Executive Magistrate. However having considered that a status quo order has been passed by the competent civil court it would be for the petitioner to alter or vary such order before a appropriate higher forum or before the civil court itself.
So far as the plea of the petitioner that the building materials of the petitioner would be destroyed and/or damaged because of the proceedings pending before the civil court the same cannot be a plea for a constitutional court to interfere.
Report submitted on behalf of the State be kept with the record.
I do not find any reason to interfere in the prayer so advanced. Petitioner would be at liberty to take steps before the appropriate forum.
With the aforesaid observations WPA 19736 of 2024 is disposed of. Pending applications if any are disposed of.
