The petitioner happens to be mother of respondent no.5. Her allegation is that she is not allowed to stay at the residence which was owned by her late husband and the respondent no.5 is enjoying the property.

On the other hand, learned advocate appearing for the respondent no.5 submits that he has no objection, if mother comes and stays in the said house, but the main difficulty arises that there is another brother who would come and his expenses are to be borne by the respondent no.5. Be that as it may, if the petitioner approaches the Inspector-in-Charge, Rahara Police Station on 28.09.2024 at about 11 a.m., then in that case the Inspector-in-Charge, Rahara Police Station would make arrangements by delegating the police personnel as he deems fit and proper ensuring free access to the petitioner at the residence. A strict

vigil be kept by the police authorities so that no harassment is inflicted upon the petitioner who is a senior citizen aged about 79 years.

With the aforesaid observations, the writ petition being WPA 19760 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
