Learned counsel appearing on behalf of the petitioner/wife submits that the husband's aforesaid suit seeking dissolution of marriage being Matrimonial Suit No.28 of 2021, in respect of which present transfer application has been filed, has already been dismissed for non-prosecution vide order no.14 dated 17.4.2023.

Accordingly, the present application has become infructuous.

In view of the above, CO 2173 of 2021 along with connected application are dismissed as infructuous. (Ajoy Kumar Mukherjee, J.)
