1. Petitioner is in custody for two years and nine months. There is inordinate delay in trial. He prays for bail.

2. We have considered the materials on record. Co-accused has been enlarged on bail.

3. Under such circumstances, petitioner is entitled to same relief and granted bail.

4. Under such circumstances, we are inclined to grant bail to the petitioner.

1. Accordingly we direct petitioner shall be released on interim bail of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Special Judge (NDPS), Raiganj, Uttar Dinajpur subject to the condition that the petitioner shall appear before the trial court on each and every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

5. In the event petitioner fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail without any further reference to this Court. (Apurba Sinha Ray, J.) (Joymalya Bagchi, J.) Signed By :
