Petitioner complains that in spite of informing the Officer-in-Charge, Swarupnagar Police Station on or about 30th July, 2025, as also the superior officer of police, no steps have been taken. Additionally, it has been submitted that the petitioner in T.S. No.112 of 2019 has been favoured with a decree by the learned Civil Judge (Junior Division), 1st Court, Basirhat. The decree is to the extent of permanently restraining from forcefully entering into the suit property or from dispossessing the plaintiff from the suit property. Petitioner till date has not been dispossessed but the agony and anxiety of the petitioner is that there has been disturbance and interference so far as the property is concerned.

Having considered that the police authorities have drawn up proceedings under Section 126 of the BNSS, I am of the view that the police authorities are well aware regarding the situation existing at the locality. Police authorities would ensure that in case there is further violation of law and order, they would take steps including an application being preferred before the learned Executive Magistrate for bond to be furnished by the persons who are interfering with the peaceful enjoyment of property of the petitioner. With the aforesaid observations, WPA 19158 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
