Learned advocate appearing on behalf of the appellant submitted that the sole appellant/convict was already granted bail by the learned Additional Sessions Judge, 1st Court & Special POCSO Court, Kakdwip, invoking Section 389 of the Code of Criminal Procedure. 2.

The appellant/convict was found guilty of committing offence under Section 8 of the Protection of Children from Sexual Offences Act, 2012 and sentenced to suffer rigorous imprisonment for three years and a fine of Rs.10,000/-, in default to suffer further rigorous imprisonment for six months.

However, considering the term imprisonment, the prayer for confirmation of bail stands allowed.

Accordingly, the appellant/convict, namely, Nilkantha Debnath shall furnish fresh bond of Rs.20,000/- (Rupees twenty thousand

only), with two sureties of Rs.10,000/- (Rupees ten thousand only) each, subject to the satisfaction of the learned Additional Chief Judicial Magistrate, Kakdwip, South 24-Parganas. 5.

Accordingly, CRAN 1 of 2023 stands disposed of. (Bibhas Ranjan De, J.)
