Petitioner is aggrieved as till date he has not received the JCB which was seized by the police authorities and has drawn the attention of the Court to the order passed on 12.11.2024 in WPA 10997 of 2024.

There were directions for establishing genuinity regarding the Engine Number, Chassis Number and the name of the owner so far as the vehicle which was registered. Accordingly, police authorities have got the vehicle inspected by the Motor Vehicles Inspector, Barasat, 24 Parganas North.

Report reflects that there was no Engine Number, Chassis Number or Number Plate.

Petitioner has approached the Executive Magistrate. Having regard to the fact that process of enquiry is still in progress, I am of the view that

there is no scope for interference at this stage. Petitioner would await the decision of the concerned Executive Magistrate who is in seisin of the issue. Accordingly, WPA 19185 of is disposed of.
