The petitioner is a retired Librarian of a Rural Library. He had filed a writ petition (WPA 9346 of 2021) before this Court claiming higher scale of pay in view of enhancing his educational qualification.

The said writ petition was disposed of by a Coordinate Bench of this Court by an order dated August 23, 2021, directing the Director of Library Services, Government of West Bengal to consider his claim. It appears that the present writ petition has been filed again with the same prayer for higher scale of pay. Learned advocate appearing for the respondent No.5 and the learned advocate appearing for the State jointly submit that the case of the petitioner was considered in terms of the said order dated August 23, 2021, passed by this Court and by an order dated October 7, 2021 the

claim of the petitioner was rejected by the relevant authority.

Learned advocate appearing for the petitioner submits that the said reasoned order dated October 7, 2021 was never communicated to the petitioner. Without going into the dispute as to whether the said reasoned order served upon the petitioner or not, I dismiss this writ petition granting liberty to the petitioner to challenge the order dated October 7, 2021 in accordance with law.

Let a copy of the reasoned order dated October 7, 2021 be made over to the learned advocate appearing for the petitioner in course of this day.

WPA 19116 of 2023 is accordingly dismissed.

There shall be no order as to costs.
