Saha ...for the petitioner Mr. Arindam Sen Ms. Ankita Pal ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a local business man who came to the spot after hearing a gunshot. The principal accused is now on bail. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies on the case diary and refers to the injury report and the statements of the victim as well as eyewitnesses. The prosecution case appears to be that the petitioner along with one Sonu Kumar Chowdhury and others came armed with sticks, iron rod and the pistol and started to assault the victim. The said Sonu made a blank fire. He was arrested and presently is on bail. A cartridge was also recovered.

Considering the materials available in the case diary and the brazen manner in which after being armed with weapons including a

pistol, the petitioner and the other co-accused came in a group and assaulted and threatened the petitioner, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail to the petitioner is rejected.
