Petitioner complains that in spite of earlier direction, the petitioner has been injured at the behest of the private respondents.

Petitioner complains of unable to enjoy the property.

Learned advocate for the State has submitted a report. Report reflects that T.S. No.70 of 2006 is pending before the learned Civil Judge (Junior Division), Barasat wherein an interim order is existing till date. Another Title Suit being T.S.No.389 of 2025 is also pending before the learned Civil Judge (Junior Division), 1st Court, Barasat wherein a status quo order has been passed which is in force till 27.08.2025. Police authorities have already drawn up criminal case being Rajarhat P.S. Case No.13 of 2025 dated 11.01.2025 against Haran Mondal and Asit Mondal.

Having considered that the police authorities are well aware regarding the situation prevailing, I direct that the police authorities would in such circumstances take steps in case there is violation of law and order. So far as the other issues are concerned, it would be for the civil court to adjudicate the dispute.

With the aforesaid observations, WPA 19170 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
