The revisional application has been preferred praying for setting aside of the order dated 14.05.2025 passed by the learned Court of the Additional District & Sessions Judge, Jangipur, Murshidabad, in connection with Raghunathganj P.S. Case No. 153/2023 dated 23.02.2023 under Section 376D of the Indian Penal Code, 1860, read with Section 6 of the POCSO Act, 2012 (P.O.C.S.O. 10/2023).

It is submitted by the learned counsel for the petitioner that it was only on one occasion that the petitioner who was asked to remain outside the Court by his learned lawyer and was not present in the Court due to inadvertence when the Court was pleased to issue the warrant of arrest. 3.
Accordingly, Mr. Bitasok Banerjee, learned counsel present in Court, an empanelled lawyer of the State of West Bengal along with the learned Public Prosecutor is appointed to
represent the State in the present case. Let his appointment be regularized by the appropriate authority.

Considering the nature relief prayed for, the revisional application is disposed of with a direction that the petitioner herein shall surrender before the trial court within 10 days from the date of this order and the trial court shall be at liberty to consider his prayer for bail, with a prayer to remain on the same bond as prayed for in the revisional application. 5.
Accordingly, the order dated 14.05.2025 passed by the learned Court of the Additional District & Sessions Judge, Jangipur, Murshidabad, in connection with Raghunathganj P.S. Case No. 153/2023 dated 23.02.2023 under Section 376D of the Indian Penal Code, 1860, read with Section 6 of the POCSO Act, 2012 (P.O.C.S.O. 10/2023) be stayed for the next 10 days.

It is made clear that in case the petitioner fails to surrender as directed, the order of stay shall stand automatically vacated.

The revisional application stands disposed of. 8.
Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of necessary formalities.
