Mr. Bhatacharya, learned advocate appearing for the opposite party submits that the present revisional application has become infructuous in view of the fact that the learned Court below has been successful in delivering the possession of decreetal tenanted property to the opposite party/landlord and the petitioner/revisionist is no more in possession of disputed tenanted property.
Mr. Bhattacharya, in support of his submission, files some documents. From the copy of the order No. 173 dated 20.01.2022 passed by the learned Judge-incharge, Presidency Small Cause Court, 3rd Bench, Calcutta, in Ejectment Execution Case No. 75 of 2021, it appears that the bailiff has been able to execute the
writ of possession and deliver the vacant possession of the disputed tenanted property to the decreeholder/opposite party herein.
Therefore, this Court is of the view that the present revisional application has become infructuous. Accordingly, the revisional application being C.O. 2180 of 2021 is dismissed as infructuous.
There shall be no order as to costs.
