Mr. Rupraj Banerjee Mr. Soham De Dhara .....for the petitioner Mr. Sudip Sarkar .....for the State Ms. Akansha Chopra Mrs. Debarati Das .....for the respondent No. 5 The petitioner prays for relief against an order passed by District Magistrate under Section 14 of the Securitisation Act, 2002 dated 23rd March, 2022/ 10th June, 2022. The case sought to be made out by the petitioner is that the petitioner has filed an application under Section 17 of the 2002 Act before the DRT-III during the pendency of which the District Magistrate passed the impugned order.

The petitioner has however not been able to show any application filed before the DRT-III under which relief has been prayed for in respect of the D.M's orders of 23rd March, 2022/10th June, 2022. The relevant application which has been placed before this Court are in relation to possession notices dated 18th February, 2021 and 24th February, 2021.

In any event, by way of a recent Notification passed by the DRT, all matters pending before the DRTIII are to be heard before the DRT-I. Hence, no relief is called for in the present writ petition nor can be granted.

WPA 19523 of 2022 is dismissed without any order as to costs.
