Petitioner is aggrieved by the fact that in spite of directions passed by the civil court in T.S.515 of 2024 by the learned Civil Judge (Junior Division), 1st Court, Howrah, the private respondents continued their act and actions particularly with regard to the violation of the order passed by the civil court, petitioner informed the local police station, however, no steps were taken by the police authorities, as such, the petitioner has approached this Court. Learned advocate for the private respondents submits that number of civil suits are pending as well as the criminal cases have been instituted.

State has submitted a report. Report reflects that a land dispute is existing, civil court is already in seisin of the issue, police authorities have already drawn up proceeding under Section 126 of the BNSS for maintaining peace and tranquility.

So far as the right, title and interest of the property is concerned, the same would be adjudicated by the civil court. However, the police authorities would oversee that there is no violation of law and order because of the strained relationship between the petitioner and the private respondents.

With the aforesaid observations, WPA 19232 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Copy of the report be handed over to both the parties.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
