28.08.2023 Item No.6 & 7 Ct. No.5 CHC C.P.A.N.1067 of 2023 Sri Rabindra Nath Bhunia & ors.
Vs.
Sri Debasish Dhali, Block Land and Land Reforms Officer, Khejuri-II With W.P.L.R.T.69 of 2023 Sri Rabindra Nath Bhunia & ors.
Vs.
The State of West Bengal & ors.
Mr. Mrinal Kanti Ghosh ...for the writ petitioners Mr. Supratim Dhar, Mr. Supriya Majumder ...for the State Affidavit of compliance is filed in Court be taken on record.
It appears from the affidavit of compliance that, the concerned Block Land and Land Reforms Officer complied with the order dated June 12, 2023 passed in the writ petition, by his order dated August 14, 2023.
Learned advocate appearing for the writ petitioners submits that the compliance is subjective in nature and draws the attention of the Court to the contents of the compliance order dated August 14, 2023.
The order dated June 12, 2023 of the High Court required the concerned B.L. & L.R.O to record the names of the writ petitioners in Khatian No.2082. The concerned B.L. & L.R.O. by the order dated August 14, 2023 incorporated the names of the writ petitioners in Khatian No.2082 subject to the rights that may be available to the State.
In contempt jurisdiction, we are not minded to enter into whether the concerned B.L. & L.R.O could reserve the rights as done in the order dated August 14, 2023.
We are of the view that, since there is substantial compliance with the order dated June 12, 2023 passed by the High Court we need not proceed any further under the provisions of Article 215 of the Constitution of India or under the Contempt of Courts Act, 1971.
C.P.A.N. 1067 of 2023 is disposed of accordingly without any order as to costs.
