The main thrust of contention in the representation was that the Block Medical Officer of Health, Chandipur was constructing a building in the land of the petitioner.

As none appears on behalf of the State, Mr. Bellal Shaikh, learned advocate who is empanelled with the office of the

Government Pleader, is directed to represent the State. His appointment may be regularized by the concerned authorities.

As the representation was made on 05.07.2022 and since then two and half years have expired, I am of the view that in respect of the construction, until and unless Civil Court passes any direction upon the government authorities, the police will not have any power to interfere with the same.

However, if the situation still persists, the petitioner will submit a fresh representation before the concerned Superintendent of Police who will consider the same in accordance with law.

With the aforesaid observations, WPA 19526 of 2022 is disposed of.

Pending application(s), if any, is also disposed of.
