In this application it is stated that the Secretary, Finance Department (Audit Branch) is not the competent authority to consider the case of the land loser exempted category under the scheme of 1999 Act.

Mr. Tapan Kumar Mukherjee, learned AGP appearing on behalf of the alleged contemnor, submits that our order dated 14th July, 2021 should be modified by directing the competent authority to consider and dispose of the said representation of the petitioner instead of Secretary, Finance Department (Audit Branch). Under such circumstances, we modify our order dated 14th July, 2021 by directing the competent authority to offer suitable appointment to the petitioner under the land loser exempted category within two months from this date.

CAN 2 of 2022 is accordingly disposed of.

In view of disposal of the CAN application by directing the competent authority to consider and dispose of the said representation of the petitioner, the contempt application being CPAN 993 of 2021 is also disposed of.

This order shall be communicated to the competent authority by the office of the learned AGP for compliance.
