Mondal .... for the petitioner Mr. Debanjan Mukherji .... for the WBSEDCL The petitioner contends that despite the petitioner having complied with the preliminary formalities on his application for new electricity service connection, the West Bengal State Electricity Distribution Company Limited (WBSEDCL) is not being able to give the same due to obstruction created by the private respondent nos.6 and 7.

Despite service, none appears for the private respondents. The affidavit-of-service filed in that regard be kept on record.

Learned counsel for the Distribution Licensee submits that for the purpose of giving such new electricity connection to the petitioner, certain installations are to be raised. However, due to resistance from the respondent nos.6 and 7 and/or their men and agents, such installations could not be made.

In view of the private respondents having chosen not to be represented despite service, the writ petition is taken up for disposal in their absence. Accordingly, WPA No. 19529 of 2022 is disposed of by directing the WBSEDCL to give a new electricity service connection to the petitioner, upon installing the necessary poles and other apparatus for the purpose of giving such connection, subject to compliance of all formalities by the petitioner, as expeditiously as possible, preferably within four weeks from the date of compliance of all formalities or this date, whichever is later.

In the event the WBSEDCL personnel face any obstruction from the private respondents and/or their men and agents in doing so, it will be open to them to approach the respondent no.5, the Officer-in-Charge, Uluberia Police Station. If so approached, the respondent no.5 shall act on the server copy of this order and grant such assistance at the cost of the petitioner.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
