And In Re : Krishna Rajbar @ Rakesh @ Mamu ..... petitioner Mr. Prabir Majumder ... for the petitioner Mr. Neguive Ahmed, learned APP Ms. Ayantika Roy ... for the State Learned Counsel appearing for the petitioner submits that the petitioner is in custody for 723 days. It is further submitted that he has been falsely implicated in the instant case.

Learned Counsel appearing for the State opposes the prayer for bail.

Having considered the materials on record and keeping in mind prima facie involvement of the petitioner in the alleged murder and as he has been identified by the eye-witnesses in the course of T.I. parade and in view of recovery of incriminating articles from the petitioner, we are of the opinion that this is not a fit case to grant bail to the petitioner at this stage. The application for bail is, thus, rejected.
