The present revision has been preferred against an order dated 01.08.2019, passed by the learned Judicial Magistrate, 1st Court at Diamond Harbour in connection with Case No.G.R.3271 of 2016, under Sections 323/354 of the Indian Penal Code by framing charge and proceeding with trial in spite of Civil Suit pending. 2.

There is no representation on behalf of the petitioners since the date of listing. The revision was last heard on 24.09.2019. 3.

As there is no representation on behalf of the State, Mr. Bitasok Banerjee, learned advocate, who is present in Court is requested to represent the State. Let his appearance be regularized by the appropriate authority.

Accordingly, the revisional application being CRR 2662 of 2019 is disposed of with liberty to the petitioner to agitate the issues raised in the present petition at the time of trial.

All applications connected thereto stand disposed of. 6.

Interim order, if any, stands vacated.

Let a copy of the order be sent to the learned trial court for compliance.
