Leave is granted to the learned advocate-onrecord of the petitioner to implead the District Primary School Council, Hooghly as party respondent in the instant writ petition. The formality of serving a copy of the writ petition upon the added respondent stands dispensed with as the Chairman of the Council has already been served with the copy of the writ petition and is being represented by the learned counsel. Leave is also granted to the learned advocate-onrecord of the petitioner to rectify the description of the respondent no. 4 in the cause title of the writ petition. The petitioner seeks 'A' category scale of pay. He approached the Court by filing writ petition being WPA

7713 of 2024 (Kingsuk Dey & Ors. Vs. The State of West Bengal & Ors.). The said writ petition stood disposed of by the Court on 15th April, 2024. Though all the petitioners in the matter of Kingsuk Dey (supra) stood on the same footing but some of the petitioners were kept out of the said order because they were from different districts. The Court was pleased to grant leave to the petitioners to file separate writ petitions on the self-same cause of action before the appropriate Bench. In the present case the petitioner is from the district of Hooghly. He has obtained his qualification for getting the benefit of 'A' category scale of pay and is entitled to such scale of pay.

Accordingly, the petitioner shall be deemed to have been qualified and entitled to receive the 'A' category scale of pay from the next date of conclusion of his D.El.Ed. training i.e. 17th March, 2019.

Let the arrears of the petitioner be paid within eight weeks from the date of communication of this order.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
