Biswajit Das @ Bishu v. State Of West Bengal
20.12.2021 sdas rejected C.R.M. 8467 of 2021 (via video conference) In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Haldia Police Station Case No. 43 of 2019 dated 17.05.2019 under Section 302 of the Indian Penal Code.
And In Re : Biswajit Das @ Bishu ..... petitioner Mr. Suman De ... for the petitioner Mr. Madhusudan Sur, learned APP Mr. Dipankar Paramanick ... for the State Learned Counsel appearing for the petitioner submits that the petitioner is in custody for more than 21⁄2 years. It is further submitted that there is slow progress in the trial of the case.
Learned Counsel appearing for the State opposes the prayer for bail.
We have considered the materials on record prima facie disclosing involvement of the petitioner in the murder of his own wife.
In view of gravity of the offence and prima facie involvement of the petitioner therein, we are of the opinion that this is not a fit case to grant bail to the petitioner. The application for bail is, thus, rejected.
Trial court is directed to expedite the trial and conclude the same at an early date preferably within one year from the
next date fixed for recording evidence without granting unnecessary adjournment to either of the parties. (Bivas Pattanayak, J.) (Joymalya Bagchi, J.)
