1. It is submitted that the petitioner has filed this revisional application challenging the order dated 06.07.2018 passed by the learned Additional Chief Judicial Magistrate, Alipore, South 24 Parganas in ACGR case no. 3593 of 2013 arising out of Tiljala PS case no. 442 dated 25.05.2013, thereby rejected the application for further investigation of Tiljala PS case no. 442 dated 25.05.2013 under sections 420/120B IPC and thereafter discharged one Mr. Dhruba Sarkar.

2. Upon perusal of the impugned order, it appears that after filing the charge sheet, cognizance was taken by the learned Magistrate and thereby rejected the naraji/protest petition filed by the petitioner.

3. Some of the prosecution witnesses have been examined, in the meantime.

4. Considering the above fact and stage of proceeding, this revisional application has become infructuous.

5. Accordingly, the revisional application is dismissed as infructuous. However, it is made clear that the trial court may proceed and come to a logical conclusion in accordance with law.

6. The connected application being CRAN 1/2019 (Old CRAN 1753/2019) is thus disposed of.

7. Interim order, if any, stands vacated.

8. Let a copy of this order be communicated to the learned court below immediately for information.
