1. Petitioner contends he is an Indian citizen and has a valid passport. On such score petitioner had been enlarged on bail. Accordingly, he prays for quashing of the proceeding.

2. I have examined the allegations in the FIR. It is alleged that petitioner had procured the passport through fraudulent means. Charge sheet has been filed against the petitioner not only under the provisions of the Foreigners Act but also for cheating and forgery. Whether the petitioner utilized forged and fabricated document to procure the passport is a triable issue which needs to be thrashed out during trial. Grant of bail to the petitioner stands on a completely different footing from a prayer for quashing of the proceeding.

3. Accordingly, CRR 3313 of 2024 is dismissed. (Joymalya Bagchi, J.)
