This revisional application has been filed under Section 401/482 of the Code of Criminal Procedure corresponding to Section 528 of the BNSS. By filing the instant revisional application, the petitioner has prayed for setting aside of the order dated June 25, 2025 as well as in MR case No. 253 of 2021 and Execution Case being No. 1676 of 2024 filed on the basis of the order dated June 25, 2025.

It is submitted on behalf of the learned Advocate for the petitioner that after the order of maintenance was passed by learned Magistrate in the aforesaid proceeding, the private opposite party no. 2 herein has contracted 2nd marriage. As such she is not entitled to maintenance from the present petitioner who is the erstwhile husband of the opposite party no. 2.

On the prayer made on behalf of the petitioner, the instant revisional application being CRR 3630 of 2025 is permitted to be withdrawn with liberty that the petitioner shall take appropriate steps before the appropriate forum.

Accordingly, CRR No. 3630 of 2025 is dismissed as withdrawn.
