Adhikari Mr. Debdip Adhikari ..... for the private respondents The petitioners' complaint that the representation made to the Panchayat Pradhan and received by the said authority on 7th December, 2021 has not been responded to or proceeded with. Learned counsel appearing for the petitioners complains of several facts which, according to counsel, would give to the petitioners right in terms of a letter of administration granted to the petitioners in respect of a certain property in August, 2018.

Learned counsel appearing for the private respondents opposes any interim prayer at this stage and submits that the petitioners have also filed a Title Suit in respect of the said property which is pending. Upon hearing learned counsel, this Court is of the view that no interim order or otherwise is called for in

the writ petition without the petitioners first approaching the Panchayat Pradhan of the concerned Gram Panchayat in terms of the representation which was received on 7th December, 2021.

The Panchayat Pradhan is directed to consider the said representation upon hearing all concerned parties including the petitioners and the private respondents and taking into account all relevant facts in the matter including the order passed by the District Court as well as this Court.

The representation is to be disposed of in terms of a reasoned order which is to be passed within four weeks from date of communication of this order and a copy of the said reasoned order be furnished to the petitioners within a week thereafter.

WPA 20305 of 2021 is disposed of in terms of the above order.
