For the State The grievance of the petitioner is that a copy of the report relied on by the respondent authorities has not been served on the petitioner. In particular, the petitioner alleges that the report of the Executive Engineer filed in W.P.A. 14132 of 2017 was not served on the petitioner. It is further submitted on behalf of the petitioner that relying on the aforesaid report a reasoned order dated 12th September, 2017 has now been passed.

Mr. Sengupta, learned advocate appearing for the State submits that this writ petition can be disposed of by directing the Executive Engineer to hand over a copy of the said report relied on by the respondent authorities.

In view of the submissions made on behalf of the State, W.P.A. 17995 of 2019 is disposed of by directing the Executive Engineer being the respondent No. 5 to

supply a copy of the aforesaid report relied on by the respondent authorities and also recorded in the order dated 15th July, 2019 passed in CPAN 1502 of 2017 in W.P.A. 14132 of 2017.

Let such exercise be completed within a period of three weeks from the date of communication of this order.

With the aforesaid directions, W.P.A. 17995 of 2019 is disposed of.

There shall be no order as to costs.

Photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
