The petitioner seeks implementation of the order of demolition passed by the Board of Councillors, Kamarhati Municipality.

Learned advocate appearing for the private respondent submits, upon instructions, that a statutory appeal has been filed before the appellate forum and the next date for hearing of the said appeal is 17th November, 2023.

As it appears that the order of demolition is already under scrutiny before the statutory appellate

forum, it will be open for the petitioner to raise all issues and make necessary prayer before the said forum.

The communication dated 7th October, 2023 addressed to the private respondent be retained with the records.

Leave is granted to the learned advocate appearing for the private respondent to file vakalatnama in the department in course of the day. The writ petition stands disposed of.
