Mr. Mohinoor Rahaman Ms. Iqra Rahaman ...for the petitioner Mr. Lalit Mohan Mahata Mr. Ziaul Haque ...for the State The grievance of the petitioner is directed against non-consideration of a representation dated July 15, 2024, inter alia, complaining of an illegal construction in violation of the guidelines of the Pradhan Mantri Ayas Yojna Scheme. It is submitted on behalf of the petitioner that the despite having made the representation as far back as in July 2024, the concerned authorities, and more particularly the Block Development Officer being the respondent no.4 herein, has taken no steps in the matter.

The State respondents are represented and submit that they have no objection if the BDO is directed to consider and dispose of the above representation. In view of the above, WPA No.20151 of 2024 stands disposed of by directing the respondent no.4 to consider and dispose of the representation dated July 15, 2024 within a period of six weeks from the date of communication of this order and in accordance with law after giving right to all the parties.

It is made clear that there has been no adjudication on the merits of the case and the respondent no.4 is to act strictly in accordance with law without being influenced by any observations made herein and after hearing all the parties.

All parties are to act on the server copy of this order duly downloaded from the official website of this court.

Certified copy of this order, if applied for, shall be made available to the parties.
