The petitioner is an approved Assistant Teacher of Work Education at Aamrpur B.A.

Girls High School, District : Purba Burdwan.

She has applied for general transfer on the grounds that the distance between her residence and the school is more than 160 K.M. and she has a child to look after, besides she is suffering from different ailments including chronic Gynecological problems.

Mr. Tripathy, learned Advocate for the State on the basis of the instruction of the District Inspector of Schools (S.E.), District: Purba Burdwan, the respondent no.3 herein submits that the prayer of the petitioner if allowed the student of the school would suffer, he files copy of the said instruction dated August 17, 2023, let it be kept with the record.

It appears on the said instruction that the Headmistress of the said School has opined that the transfer of the petitioner would affect the learning process of the 452 students of the school.

In view of such position of the matter this Court is not inclined to allow the prayer of the petitioner, accordingly WPA 19212 of 2023 is dismissed without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
