The petitioner was serving in the post of Para Teacher (Primary) of a primary school under the Paschim Banga Sarva Siksha Mission. He was taken in custody in connection with a criminal case in December 2023 and he obtained bail in January 2024.

After being enlarged on bail, he went to the school to resume his service but he has been prevented to join the school.

A representation has been made by his learned advocate requesting the respondent authority to permit the petitioner to join service. The same is pending consideration.

Without entering into the merits of the application filed by the petitioner, the instant writ petition is disposed of by directing the District Project Officer, Paschim Banga Samagra Shiksha Mission to

consider and dispose of the representation made on his behalf in accordance with the prevailing rules, regulations and circulars at the earliest, but positively within a period of six weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.

Learned advocate for the petitioner is directed to forward a copy of the legal representation dated 7th July, 2024 along with all documents in support of his prayer for resumption of service to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
