And In Re : Abdul Mannan Mondal ........ petitioner Ms. Karabi Roy ...... for the petitioner Mr. Saryati Datta ...... for the State It is submitted on behalf of the petitioner that no narcotic substance was recovered from his possession. The petitioner is in custody for 264 days.

Learned lawyer for the State opposes the prayer for bail and submits that petitioner was transporting narcotic substance above commercial quantity. Seeing police personnel, they fled away. Upon hot chase, the petitioner was arrested.

Having considered the materials on record and bearing in mind the statements of witnesses prima facie disclosing involvement of the petitioner in transporting narcotic substance above commercial quantity and the contemporaneous materials showing his arrest near the spot upon hot chase, we are of the opinion this is not a fit case where the petitioner may be enlarged on bail.
