The petitioner is an Assistant Teacher of a Christian Minority School and is praying benefit of annual increment of five years for the period from 2017-2021.

During the pendency of the present writ petition the District Inspector of Schools (S.E.) Kolkata, the respondent no. 3 herein, by his order dated August 26, 2022 has refused to grant the said benefit of the petitioner.

Mr. Dey, learned Counsel for the petitioner submits that though an application for amendment of the writ petition has been taken out to incorporate the said subsequent event but his client has been advised to file a comprehensive writ petition challenging the said order of the respondent no. 3, therefore, the petitioner prays leave to withdraw the present writ petition.

In view of such stand of the petitioner W.P.A. 19577 of 2022 is dismissed as withdrawn without any order as to costs.

This order, however, will not prevent the petitioner to challenge the order of the respondent no. 3 dated August 26, 2022 in accordance with law.

In view of the disposal of the writ petition the connected application being I.A. No. CAN 1 of 2023 has become infructuous and is accordingly disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
