This is a joint application for recording compromise of a criminal case being G.R. Case No.4383 of 2016 arising out of Santragachi Police Station Case No.57 of 2016 under Section 498A of the Indian Penal Code pending before the learned Judicial Magistrate, 1st Court at Howrah.

By filing the aforementioned application, the parties to the proceeding have stated that the dispute between the parties has been amicably settled and the de-facto complainant does not want to proceed with the case.

This Court sent notice to the Officer-in-Charge of Santragachi Police Station requesting him to record the statement of the de-facto complainant to ascertain as to whether such settlement is being made through coercion, undue influence, threat etc. The Investigating Officer has recorded further

statement of the de-facto complainant where she clearly stated that due to marital discord she filed the instant case as well as the matrimonial suit praying for divorce. The said matrimonial suit has been disposed of. Now, the de-facto complainant does not want to proceed with the criminal case filed against her husband and other matrimonial relations.

In view of such circumstances, joint application for compromise is accepted and further proceeding of G.R. Case No.4383 of 2016 pending before the learned Judicial Magistrate, 1st Court at Howrah is quashed.

The report submitted by Mr.Kashinath Mondal, S.I. of Police, Santragachi Police Station be kept with the record. ( Bibek Chaudhuri, J. )
