The petitioners have expressed their agony for being detained in custody since October, 2018, which is almost 38 months.

It has been brought to the notice of the Court that charge-sheet was submitted in the year 2019 and charge was framed on December, 2019.

According to the learned advocate appearing for the petitioners, although recording of evidence has commenced, but the same is at long intervals which is affecting the personal liberty to the present petitioners.

Ms. Debjani Sahu, learned advocate, is directed to appear on behalf of the State to assist the Court. Her appointment may be regularised by the concerned authorities.

It has been brought to my notice that the next date is fixed on 19th February, 2022 and 21st February, 2022. In view of the long detention of the petitioners, I direct the learned special court to fix at least schedule of three dates on each and every month and take the trial to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties and schedule/date should be fixed only after the public prosecutor conducting the case assures the court regarding the availability of the witnesses. With the aforesaid observations, CRR 2538 of 2021 is disposed of.
