The present appeal has been preferred against a judgment of affirmance. Both the courts below dismissed the suit of the plaintiff for compensation on the ground of non-supply of working capital of Rs.11,800/- which was sanctioned on June 20, 1988. 2.
The suit was filed on November 27, 2009 whereas, even as per the plaint case, the first refusal of the defendant/respondent/bank to disburse such working capital took place on July 21, 1989. Both the courts below applied Article 55 of the Limitation Act and held that the suit was palpably barred by limitation. We do not find any illegality and/or infirmity in the judgments and decrees of the courts below for us to admit the appeal. Moreover, no substantial question of law is involved at all. 3.
Accordingly, SA 148 of 2022 is dismissed under Order XLI Rule 11 of the Code of Civil Procedure, without any order as to costs.
