AB C. O. 3025 of 2025 Ashok Das @ Ashoke Kumar Das Vs Sadhana Das Mr. Shibaji Kr. Das, Mr. D. Sarkar, Mr. Subranil Roy .....for the Petitioner. This application under Article 227 of the Constitution of India is at the instance of the husband praying for a direction upon the learned Additional District Judge, 15th Court, Alipore to dispose of Matrimonial Suit No.75 of 2013 expeditiously. The learned advocate appearing for the petitioner submits that the petitioner is regularly paying alimony to the wife/opposite party herein pursuant to the order passed by this Hon'ble Court. He submits that the evidence of the petitioner in the matrimonial suit has already been concluded and it is for the wife to adduce evidence.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing her before the learned Trial Court.

Though the learned advocate appearing for the petitioner submits that the husband/petitioner is regularly paying alimony pendentelite, but this Court finds that by an order dated 17.05.2025, the learned Trial Judge directed the husband/petitioner to pay maintenance pendentelite to the wife/opposite party within 10th of every succeeding month by cash or by bank draft or by NEFT from May, 2025 onwards after taking bank account details from the wife/opposite party.

Mr. Das, learned advocate appearing for the petitioner submits that the petitioner is complying with the direction passed by the learned Trial Judge. In the light of the submission made by the learned advocate for the petitioner, C.O. No.3025 of 2025 stands disposed of by requesting the learned Additional District Judge, 15th Court, Alipore to make an endeavour to dispose of the Matrimonial Suit No.75 of 2013 as expeditiously as possible without granting any unnecessary adjournment to either of the parties provided the petitioner is not in default in payment of alimony pendentelite.
