Mr. De, learned advocate appearing for the appellant submits that the present appeal has been inadvertently filed before this Court and prays for leave to withdraw the same so that the appeal may be filed before the appropriate forum.

In view thereof, the present appeal and the connected application are dismissed as withdrawn and the appellant would be at liberty to prefer the appeal before the appropriate forum, in accordance with law. The department is directed to immediately hand over the certified copy of the impugned order to the learned advocate on record of the appellant upon retaining a xerox copy of the same.
