1. The appeal is not maintainable in view of Section 21(1) (a) of the Bengal, Agra and Assam Civil Courts (West Bengal Amendment) Act, 2000.

2. In view thereof, the appeal stands dismissed as not maintainable.

3. However, liberty is given to the appellant to approach the proper forum.

4. The department is directed to return the certified copy of the judgement after retaining the photocopy of the same in order to enable the appellant to approach the appropriate court.

5. We make it clear that we have not gone into the merits of the case.
