Affidavit-of-service is taken on record. Despite service, none appears on behalf of any of the respondents. As this Court is not inclined to pass any mandatory directions as prayed for by the petitioners in the writ petition, but is relegating the entire dispute before the competent authority under law, the writ petition is taken up and disposed of in their absence.
The petitioners are the local inhabitants of Patharpratima Development Block under the Brajaballavpur Gram Panchayat, District-South 24Parganas.
The petitioners allege that the village market/'hat' under the control of the panchayat authorities, is in a dilapidated condition and the roof may collapse any time. Grave injury may be caused to the villagers who go to the market. The allegation is, that proper materials had not been used for such construction. The petitioners have relied on some photographs. The Pradhan of the concerned
gram panchayat was approached by the petitioners. The petitioners pray that a decision be taken for repair/reconstruction of the 'hat'.
Under such circumstances, liberty is given to the petitioners to make a representation before the Block Development Officer, Patharpratima Development Block with their grievances. If such representation is made, the same shall be disposed of in accordance law and remedial measures shall be taken. If it is found that the 'hat' requires repair and maintenance, in that case necessary steps shall be taken by the authorities, in accordance with law. The safety and security of the villagers who frequent the 'hat', should be of primary consideration.
The entire exercise shall be completed within a period of six months from the date of receipt of the representation.
The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are to act on the basis of the server copy of this order.
