Mr. Nirmalendu Bera, Mr. Gora Chand Samanta, Ms. Gopa Das ...for the Petitioners Mr. Kanak Kiran Bandopadhyay ...for WBSEDCL This writ petition has been filed seeking an electricity 11-09-2025 AKG Ct. 15 connection for the petitioners' shop room located at Basanti Bazar under the jurisdiction of Basanti Police Station, South 24 Parganas.
Learned counsel appearing for the petitioners submits that the electricity connection was disconnected on January 30, 2013, due to non-payment of electricity dues. It is further submitted that the outstanding amount was paid by the petitioners on March 30, 2024. It is submitted that in view of the passage of approximately 12 years since disconnection, the restoration of the original electricity connection is not feasible.
Learned counsel further submits that the petitioners are willing to submit a fresh application for a new electricity connection.
In light of the above, liberty is granted to the petitioners to submit a fresh application for an electricity connection. If such application is submitted, the electricity supply to
the petitioners' premises shall be provided, subject to compliance with all applicable formalities within three weeks from the date of such application.
Learned counsel for the petitioners also prays for the disconnection of the electricity supply to respondent nos. 4 to 7, alleging that their shop rooms have been constructed on a plot belonging to the petitioners.
However, this Court is of the view that such disputes involve questions of fact and title that cannot be adjudicated in the present writ proceedings. Accordingly, the prayer for disconnection of electricity supply to respondent nos. 4 to 7 is not entertained.
WPA 19247 of 2025 is accordingly disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
