For the State The petitioner alleges that the private respondents have raised unauthorised construction by encroaching upon an area measuring 792 sq. ft. or approximately 0.018 acres of a link road belonging to the Panchayat.

Learned counsel for the petitioner takes this Court to a report submitted by the Assistant Director and Block Land and Land Reforms Officer, Daspur-II, Paschim Medinipur before the Sub-Divisional Officer, Ghatal, Paschim Medinipur which demonstrates such encroachment.

The petitioner submitted a representation before the concerned authority on 24th July, 2024 in this regard which is yet to be considered. The petitioner seeks consideration of the same. Upon consideration of the submission made on behalf of the parties, this Court directs the Pradhan, 9 no. Gochhati Gram Panchayat, being the 8th respondent herein, to consider and dispose of the representation submitted by the petitioner dated 24th July, 2024 within

six weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioner and the private respondents in terms of 25(2) of the West Bengal Panchayat Act.

The decision taken by the authority shall be communicated to the parties within a week thereof. The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
