And In Re : Tapas Saha @ Tapan .... .... petitioner Mr. Sumanta Das ....for the petitioner Mr. Ranabir Roy Chowdhury Mr. Sandip Chakraborty ...... for the State Apprehending arrest in connection with Nadanghat Police Station Case No. 327 of 2021 dated 06.10.2021 under Sections 20(b)(ii)(c ) of the Narcotic Drugs and Psychotropic Substance Act, 1985, the present application has been preferred. Mr. Das, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated in the alleged offence. He has no antecedent and in the said conspectus custodial interrogation is not necessary. Mr. Roy Chowdhury, learned advocate appearing for the State opposes the petitioner's prayer and submits that contraband substance above commercial quantity was recovered from the house of the petitioner. In support of such contention he draws our attention to the seizure list as well as property documents.

We have heard the learned advocates appearing for the respective parties and considered the materials in the case diary.

Prima facie it appears that contraband substance above commercial quantity was recovered from the house of the petitioner and as such his involvement in the alleged offence cannot be totally ruled out and in view of the statutory restrictions, we are not inclined to exercise discretion in his favour and his prayer for anticipatory bail is refused. Accordingly, the application for anticipatory bail being C.R.M. No.8505 of 2021 is dismissed.
