Learned senior counsel appearing on behalf of the petitioner submits as follows. The supplementary affidavit filed earlier is not pressed. No prima facie case is made out against the present petitioner as would be evident from a plain reading of the First Information Report. Any further continuation of the impugned proceeding shall be an abuse of the process of the Court. Learned senior counsel appearing on behalf of the State submits that the petitioner has not yet been made an accused in this case. The case was started at the behest of a photographer against unknown persons. The same is being investigated. As the petitioner has not yet been made an accused in this case, the present application for quashing of proceeding at his behest becomes infructuous.

Accordingly, the same is disposed of, without any further order, even as to costs.

However, in the event the petitioner is made an accused in this case, the Investigating Officer shall intimate the same to the petitioner with an adequate notice in terms of Section 35(3) of the BNSS.

In the event the petitioner is made an accused in this, he shall also be at liberty to pray for appropriate relief in accordance with law. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
