In my opinion, the revisional application is not maintainable. The order impugned is an appealable order because the same has been passed in an application under Section 9(3) of the Guardians and Wards Act, 1890. Further, the prayer of the petitioner can be considered in an application under Section 24 of the Code of Civil Procedure. The revisional application is dismissed.

The petitioner is granted liberty to file afresh on the selfsame cause of action under the appropriate provisions of the Code of Civil Procedure.

There shall be no order as to costs.

Parties are directed to act on the basis of the server copy of this order.
