Affidavit of service filed on behalf of the petitioner is taken on record.

By the present writ petition the petitioner seeks direction upon the respondent authorities to disburse the interest amount towards the pensionary benefits including arrear family pension till the date of actual disbursement of amount together with interest at the rate of 18% per annum.

The petitioner contends that his father was an Assistant Teacher in Jarighati Primary School, Dhumsai in the district of Jhargram and died-inharness on 12th January, 1980. The petitioner's mother died on 31st January, 2013. The petitioner is the only legal heir of the deceased teacher. The petitioner approached the concerned authority for payment of interest on delayed payment of pension.

However, since no steps have been taken, hence this writ petition.

Mr. Sourav Mitra, learned advocate for the petitioner submits that the petitioner is entitled to receive interest on delayed payment of pensionary benefits. He relies on the Circular dated 15th June, 1990. 5.

The learned advocate for the State leaves the matter to the discretion of the court.

In view of the above, respondent no. 2, the Director of Pension, Provident Fund & Group Insurance, Government of West Bengal and respondent no.3, Treasury Officer, Jhargram are directed to disburse the interest @ 8% per annum to the petitioner on the amount released in favour of the petitioner by way of the pensionary benefits including arrear family pension on and from 15th June, 1990 till the date of issuance of the Pension Payment Order.

Learned advocate for the petitioner is directed to communicate this order to respondent no. 2, the Director of Pension, Provident Fund & Group Insurance, Government of West Bengal and also the respondent no.3, Treasury Officer, Jhargram for necessary compliance.

With the aforesaid directions, the writ petition being WPA 19048 of 2025 is disposed of.

Since no affidavit is called for, the allegations made in the writ petition are deemed to have been denied. 10.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
