The prayer of the petitioners is that the representation made by the petitioner no.1 to the Principal of the concerned College on 6th November, 2019 for the compassionate appointment of the petitioner no.2 be considered by the Director of Public Instruction.
The case is that the father of the petitioner no.2 died in harness on 31st October, 2019 and a prayer for compassionate appointment was made on 6th November, 2019. The petitioners are the mother and the son of the deceased. It appears from other documents in the writ petition that the concerned College wrote to the Director of Public Instruction on 3rd July, 2020 proposing the name of the petitioner no.2 against a vacant post of Laboratory Attendant, Physics (Morning Section) and asked the Director of Public Instruction to sympathetically consider the case of the petitioner no.2. The petitioners' lawyer also made a demand for justice to the Director of
Public Instruction on 19th April, 2021. None of these letters have responded to till date.
The University is represented.
Upon considering the case of the petitioners, WPA 20384 of 2021 is disposed of with a direction on the Director of Public Instruction, being the respondent no. 2, to consider and dispose of all the representations made by the petitioners or on their behalf including that of the concerned College made on 3rd July, 2020 and pass a reasoned order upon hearing all concerned parties including the petitioners within a period of four weeks from date. Any further delay on the part of the Director of Public Instruction will invite appropriate orders. A copy of the reasoned order shall be given to the petitioners within three days from the date on which such order is passed.
Needless to say, if the concerned petitioner is found eligible, the appointment shall be given without any further delay.
Urgent phtotostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
