It has been brought to the notice of the Court that the petitioner is in custody since 27th February, 2020 and although charge-sheet has been submitted and charge has been framed on 30.03.2021, but no witness till date have been examined. Ms. Debjani Sahu, learned advocate, who ordinarily appears on behalf of the State, is directed to appear in this matter to assist the Court. Her appointment may be regularised by the concerned authorities.

Learned advocate for the petitioner submits that the next date has been fixed on 7th February, 2022.

In view of the detention of the petitioner since February, 2020, I direct the learned special court on and from 7th February, 2022 would fix a schedule consisting of three dates. Such schedule

must be fixed at least once in every three months. No unnecessary adjournment should be granted to either of the parties and schedule/date should be fixed only after the public prosecutor conducting the case assures the court regarding the availability of the witnesses.

With the aforesaid observations, CRR 2544 of 2021 is disposed of.
