Adhya ... for the private opposite party A report has been submitted by the Inspector in charge of Harishchandrapur P.S., District-Malda, in connection with Harishchandrapur P.S. 743 of 2023, wherein this court was pleased to impose the conditions that the accused persons would stay outside the district of Malda and they will enter the jurisdiction of Malda only with the permission of the office of the Superintendent of Police, Malda.

The report so submitted in paragraph IV reflects that an enquiry was conducted by the Inspector in charge of Harishchandrapur PS and it was found that the accused

persons have been complying with the conditions so imposed by this court in CRM (SB) 165 of 2023. In view of the report so submitted, CRAN 1 of 2023 is dismissed as infructuous.

So far as the CRAN 2 of 2023 is concerned, the same has been preferred for allowing the accused persons to enter into the jurisdiction of Harishchandrapur P.S. along with the other prayers.

Having regard to the fact that the accused persons since 15th September, 2023 have been complying with the order and taking into account the nature of the offence, I am of the view that further imposition of the conditions are unwarranted.

Accordingly, the conditions so imposed by this court in the order dated 15th September, 2023 is here by waived. However the accused persons shall be present on the date so fixed before the ld. jurisdictional court. With the aforesaid observations, CRAN 2 of 2023 is disposed of.
