The present revisional application has been preferred in respect of NDPS Case No.41/2020 arising out of Dankuni Police Station Case No.128/2020 under the relevant provisions of NDPS Act.
The petitioners are aggrieved by the manner in which the proceedings are progressing, although they are in custody since August, 2020.
Records reflect that on 04.10.2021 charge has already been framed and it has been submitted that the next date has been fixed on 1st June, 2022 for evidence.
Ms. Manisha Sharma, learned advocate, is directed to represent the State. Her appointment may be regularised by the concerned authorities.
Having regard to the period of detention of the petitioners, I direct that the learned trial court shall fix schedule consisting of three dates on and from 1st June, 2022 and such
schedule shall be fixed on every 60 days. No unnecessary adjournment should be granted to either of the parties and the learned public prosecutor appearing on behalf of the State should ensure the presence of the witnesses on the date so fixed. Further, the learned court would fix date after availability of the witnesses is assured by the learned public prosecutor. All efforts must be taken by the learned court so that the trial of the case is concluded within a reasonable period of time.
With the aforesaid observations, CRR 2547 of 2021 is disposed of.
